摘要：从权利哲学的视角来看,人权是一种人之所以为人的权利。这种权利具有超验的先在性,它不会因为时间空间的转换而改变。以价值为指引的哲学思辨深刻地影响了现实社会对于人和人的行为的认识,无论在哪种社会形态中,保障基本的人权都是社会的必然选择。从这个角度来讲,网络社会并不是一个可以外在于现实社会的独特领域,网民也不是可以免于权利规范的特殊主体,它和现实社会一样,网民既享有基本的权利,也必须遵循特定的社会法则。
From the perspective of philosophy of rights, human right is a right to be a human- This right is mainly characterized by transcendent existence which won＇t change with the change of time and space. The philosophic thinking value oriented has a profound impact on people＇s social understanding of people and human＇s behavior. No matter what kind of class society, protecting the basic human rights must become us the inevitable choice. From this perspective, the network society is not a unique field out of touch with the real society. Internet users are not special subjects who exempt from the rights regulation. Like the people in real society, the netizens not only enioy the basic human rights but also follow specific rules of society.
