摘要：图书馆对馆藏绝版作品的数字化开发利用受到版权问题的制约。对此,法国开展了积极的立法探索,开辟了不同于欧盟和欧盟其他成员国的立法进路,将绝版作品数字化置于版权默示许可制度的规范之下,这项制度具有向图书馆免费许可的公益导向,以及授权便捷、规模效益、法律确定性和注重保护权利人利益等特征。我国现行数字版权默示许可制度并非专门为图书馆建立,针对性不强,而且存在规定不全面、不细致以及部分重要法律内容缺失等问题。建议从国情出发,学习汲取法国立法的有益经验,设计出适合我国图书馆的绝版作品数字化版权解决方案。
Library's digital exploitation of out-of-commerce works in its collections is hampered by copyright issues. For this reason, France has had proactive legislative explorations, placing the digitalization of out-of-commerce works under the implied copyright license system, which has the public welfare orientation of free license to libraries, as well as the features of convenient authorization, economies of scale, legal certainty and focus on protecting the interests of rights holders. China's current implied license system of digital copyright is not specific to libraries, and has problems such as incomplete and imprecise regulations and lack of essential legal contents. It is suggested that China should proceed from current national conditions, borrow ideas from French legislation, and design a digital copyright solution for out-of-commerce works suitable for Chinese libraries.
