摘要：From the perspective of philosophy of rights, human right is the right of the human being a human. This right is characterized by transcendent presence and will not be changed because the changing of time and space. The philosophy led with values has a profound impact on the social understanding of the people and the human behaviors. No matter in what kind of society, protecting the basic human rights had become the inevitable choice. From this perspective, the network society is not a unique field in the real society, and the Internet users are not the special subject which exempts from the rights regulation. Like the people in the real society, they not only enjoy the basic human rights, but also must follow specific rules of the society. In recent years, the country's legislative, judicial and public security departments increase the punishment of the network rumors. A number of network rumor mongers who have adverse effects in the society have received legal sanction, and the major social events that manufacture the rumors to influence the social public order through the network began to decrease, and the network order has been restored. However, in the process to hit the rumors, whether from the government's point of view, or from the ordinary people's point of view, some controversial places always exist for the application of the laws and the rights. Generally, the debates of the current academic circle on the Internet rumors mainly have two research angles. First, how to determine what are the Internet rumors, how to judge the degree of harm of the network rumors, and how to conduct the legal definition and sentencing of the behaviors of the rumor releasers. Secondly, what other methods to hit the Internet rumors in addition to the legal means, namely, whether to reflect the related factors of the political environment and the social environment, and how to push forward the reform especially at the political level. The author thinks that the discussion of the problem of the network rumor with the system and legal point of view is a reflection of the current status of China's political development in the academic circle, but in terms of the emphasis, these topics laying the emphasis on the technical aspects neglect the rights of the subjects in the center position. Therefore, this paper will carry out the related discussion based on the perspective.
