摘要：通过完善版权制度来规制数据商滥用版权是重要的法律选择。相对于合理使用制度存在权利性质不明、无法对抗契约效力、被技术措施锁定,导致对抗滥用版权乏力的局限性,法定许可制度更具利益平衡功能、排斥拒绝许可和单方面的权利限制、防范数据商提出高索价要求等特征,能遏制数据商滥用版权。在我国建立图书馆法定许可制度,需要对适用评估、使用定价、报酬转付、通知公告、侵权救济等法律内容作出科学的安排。
It is important to regulate the copyright abuse of database vendors by improving copyright system. Issues of fair use system, such as unknown nature of rights, irresistible validity of contracts and locking of technical measures,result in weak counterbalance of copyright abuse. Statutory license system,featured with maintaining balance of all interests,avoiding the decline of licensing and the unilateral restrictions on rights,and preventing overcharging,curbs the copyright abuse of database vendors effectively. To establish a statutory license system for library, there is a need to make scientific arrangements of the clauses concerning applicability evaluation,pricing,transfer payment,notice and announcement,and tort remedies.
