摘要：简述《信息网络传播权保护条例》的实施有助于改善图书馆领域的利益平衡关系,指出其在拓展图书馆从事数字信息服务法律空间的同时,也给图书馆带来了某些不利影响,如没有使倾斜的利益天平完全得到矫正、图书馆远程在线信息服务的法定许可权利缺失等方面。提出应对信息网络传播权法律保护新环境的挑战,必须充分认识《条例》对图书馆现代化建设的重要性,切实提高图书馆员和读者的知识产权素质,对照该《条例》规定建立健全著作权管理制度,认真开展图书馆藏的著作权评价工作,继续参与立法进程中公权和私权的博弈与制衡。
This paper briefly introduces the Protection Act of Information Network Propagating Right（PAINPR） and its helpful functions in balancing the relations of interests among each field of library, and thinks that it extends the legally rights of digital information services of libraries. At the same time, the paper points out that PAINPR also brings some unfavorable influences on libraries, such as not completely correct the inclined interests balance, lose the fight of long-range online information service and so on, The paper proposes that people should fully recognize the importance of PAINPR to the building of modernization, practically improve the intelligence fight knowledge of librarians and readers, perfectly establish the management rules of copyright; ＂carefully develop the assessment work of library copyright, and persistently participate in the struggling between public fight and private right in legislation, so as to respond the challenges of new environment which PAINPR brought.
