摘要：在与图书馆的数据库贸易中,数据库出版商利用版权垄断地位滥用许可权,有可能排除、破坏、妨碍或限制竞争,扰乱市场秩序,用反垄断法对数据库出版商滥用许可权的行为予以规制有坚实的法理基础。数据库出版商滥用许可权的行为包括"搭配销售""价格控制""拒绝许可""权利限制"等。由于版权适用反垄断法例外原则,因此这些行为并非都必定会受到反垄断法追究,需针对具体情况分析判断。我国调整知识产权许可的反垄断立法有待完善,切入点包括科学选择政策取向、开展专门性立法、建立详细的操作指南、确定违法审查标准等。
In library database trading, it is possible for publishers to use copyright monopoly to abuse of the licensing right, so as to eliminate, destroy, impede or restrict competition and disrupt the normal market order. Therefore, regulation and sanction should be given to curb publishers＇ abuse of permissions based on the anti- monopolylaw. Database publishers＇ abuses oflicensing right includes ＂tie-in sale＂, ＂price control＂, ＂refusing to license＂, ＂rights restriction＂. Because the exception principle of anti-monopoly law is applicable to copyright, those abuses might not hold accountable by the anti-monopoly law, and need to be analyzed according to specific situation. Chinese anti-monopoly legislation which regulates the licensing of intellectual property in China needs to be improved, including improving the orientation of scientific selection policy, carrying out special legislation, providing detailed operational guidelines, and determining illegal examination standards.
