摘要：开放资源是处于“特殊版权状态的资源”,许可协议是保护其版权的规则;违反许可协议,既是道德问题,更是“违约性的侵权行为”;保护开放资源,除了要创新授权模式外,关键是要对现行法律作出调整,但不应使开放存取制度走向同版权完全对立的另一个极端。
The Open Access resources are the resources that in a special state conceming copyright and permission agrements which act as the rules to protect it. Any form of violating the agreements is both a legal problem of infringing upon copyright and a moral degradation. To make the Open Access resources be surely protected, we should innovate in authorizing mode of copyright, especially perfect the legal provisions, while refrain from going to extremehess that makes Open Access and copyright diametrically opposed to each other.
