摘要：2009年7月在美国发生的"亚马逊删除电子书事件"是平衡电子书版权保护与最终用户利益的典型例证。这其中涉及到内容与载体的可分离性、首次销售原则的适用性、版权保护技术的平衡性、应用豁免规则的责任性等问题。为平衡电子书版权保护与最终用户利益,应强调用户利益在版权法中的重要地位,正确把握技术措施保护版权的强度,不断探索和创新数字版权授权模式,积极打造丰富的电子书版权内容平台,协调与整合电子书版权链的利益关系。
Amazon deleting e-books event happened in America in July 2009,The event is the typical example of the balance of e-book copyright protection and end-user interests. The event involves the separation of contents and carriers, the applicability of the first sale doctrine, the balance of copyright protection technologies, the responsibility of application exemptions, and so on. In order to balance e- book copyright protection and end-user interests, we should pay attention to the importance of user＇s interests in the copyright law, hold the strength of copyright protection with technical methods actually, explore and innovate the digital copyright authorization mode continually, establish rich e-book copyright content platform actively, coordinate and integrate the interest relationship of e-book copyright chain.
