摘要：随着现代科学技术的发展、市场经济的深化以及新闻传媒的发达,使人格权的商业利用价值显著提高,人格权商品化已经成为一种发展趋势。面对人格权商品化过程中出现的权利受侵害现象,明确其侵权责任,对于保护权利人的合法权益,预防并制止侵权行为,促进社会和谐稳定,具有重要的意义。人格权商品化侵权行为的表现形式主要有擅自使用、假冒使用、模仿使用及诋毁使用等。判定人格权商品化的侵权行为应适用无过错责任原则,其侵权构成要件主要为行为违法性、有损害结果的发生、行为违法性与损害结果之间的因果关系等。侵害人格权商品化的责任方式,应以财产损害赔偿为主,兼采其他责任方式。
With the development of modern science and technology,and with the deepened development of market economy and news media,the value of the commercial exploitation of personality rights has been significantly increased,and commercialization of personality rights has become a trend.Considering the infringements in the course of commercialization of personality rights,it is of great significance to clear the tort liability,so as to protect the legitimate interests of right holders,prevent and stop the infringements,and promote social harmony.Violations of commercialization of personality rights mainly include unauthorized use,use of counterfeit,imitation use and use of low-destruction.The principle of liability without fault should be applied to determine the commercialization of personality rights＇ violations,the main elements of which constitute act illegitimacy,results of having been damaged,the causal relationship between act illegitimacy and results of having been damaged,and the infringements sufficient to mislead the public.Responsibility for infringing the commercialization of personality rights should mainly be compensation for property damage,along with other responsibility ways.
