摘要:非公企业工会作为劳动者合法权益的代表,在对异地务工人员进行心理疏导、推动用人单位建立工资集体协商机制等方面发挥了重要作用。但也面临独立性不足、难以有效协调劳资关系,法律法规不完善、工会维权缺乏强有力的法律支持,非公企业工会"老板化"、工会代表劳动者权益的作用难以真正发挥等困境。要走出这些困境,一是明确非公企业工会的定位,提升非公企业工会的维权职能;二是增强非公企业工会的独立性,奠定有效协调劳资关系的基础;三是完善非公企业工会维权的保障机制,切实维护劳动者的合法权益。
As legitimate interest of labor ’s representative in non -public enterprises ,the labor u-nion plays an important role in constructing a system of collective bargaining and psychological counseling for alien workers .But because of the particularity of non -public enterprises’ nature ,the labor union have a lot of problems ,to solve these problems ,we should clearly positioned labor union of non -public enterprises ,promoting the ability of labor union in protecting legitimate rights ,strengthening the independence of labor unions ,and improving the safeguard mechanism of protect legitimate rights .
