摘要:我国不动产登记制度较为混乱和不规范,导致现实中因第三人对登记的信赖进行交易而遭受侵害的情况时有发生,所以应在不动产上设立善意取得制度。但在适用不动产善意取得时要把第三人对不动产的占有现状的考察与是否善意联系起来,只有当第三人对不动产占有现状进行了考察,尽了合理的注意义务,才能适用善意取得制度取得不动产权利,也就是用占有的权利外形来补充加强登记的公信力,这样善意取得制度在保护第三人的基础上也在一定程度上保护了所有人的利益。
Due to the real estate registration system is more confusion and irregularities that led to the third person to transactions for trust of registration,which caused violated their situation in our country.It should be set up the system of bona fide acquisition in real estate.However,the third person would like to investigate situation of the possession of the real estate and make a reasonable duty of care,which can apply to the bona fide acquisition of real estate.This is the rights in shape of possession to strengthen the credibility of registered,in this case,the bona fide acquisition on the basis of protection of the interests of third person that to protected the poisoner at certain extent.
